1) Acceptance of Terms

By accessing or using defundsimping.com, purchasing programs, scheduling calls, or participating in coaching, groups, or courses offered by Defund Simping ("Company," "we," "us," "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our services.

2) Who We Serve; Age

Services are intended for individuals 18 years or older. By using our services, you represent that you are at least 18.

3) Coaching Disclaimer (Not Therapy, Medical, or Legal Advice)

We provide coaching and educational content. We do not provide medical, mental health, legal, or financial advice and we do not diagnose, treat, or prevent disease or disorders. If you need such services, seek a qualified professional. You remain responsible for your decisions and outcomes.

4) Accounts, Communications & Consent

You may need an account to access certain services. Keep your credentials confidential.

By providing your contact details, you consent to receive service communications and, where permitted, marketing via email/SMS. You can opt out of marketing at any time (service messages may still be required).

We may record sessions or calls only with prior notice and your consent.

5) Scheduling, Cancellations, No-Shows

Scheduling is handled via our online calendar. Reschedule/cancel policies are shown at booking.

Missed appointments and late cancellations may be forfeited per the policy shown at checkout or in your booking confirmation.

6) Pricing, Payments, Subscriptions, Refunds

Prices are shown at checkout and may change prospectively.

Payments are processed by our payment provider (e.g., Stripe). You authorize us to charge the payment method you provide for purchases and any agreed installments or subscriptions.

Refunds: Unless otherwise stated at checkout or in your order form, all sales are final. If a specific guarantee or refund window is offered, its terms at checkout prevail.

Chargebacks: You agree to contact us first to attempt good-faith resolution. Unfounded chargebacks may be treated as breach of contract.

7) Client Responsibilities

Show up on time, engage honestly, complete agreed actions, and respect community guidelines.

You are responsible for your results; coaching provides guidance and accountability, not guaranteed outcomes.

8) Community Conduct

No harassment, hate, doxxing, or illegal activity.

Keep other members' information confidential.

We may remove participants who violate these rules without refund.

9) Intellectual Property

All content, programs, frameworks, and materials are owned by us or our licensors and are protected by law.

We grant you a personal, non-transferable, revocable license to use purchased materials for your own learning. No redistribution, resale, or public posting without written permission.

10) User Content, Testimonials & Likeness

If you submit comments, wins, or testimonials, you grant us permission to use them (and your name/likeness if provided) for marketing, subject to any written permissions we agree.

You are responsible for content you post and you warrant you have rights to share it.

11) Third-Party Services

We use third-party providers such as GoHighLevel (CRM/forms/calendars/email/SMS/calls), payment processors (e.g., Stripe), analytics, ad platforms, and video services. Their services are subject to their own terms and policies.

12) Warranty Disclaimer

Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant specific results.

13) Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from your use of the services. Our aggregate liability for any claim is limited to the amount you paid to us for the service giving rise to the claim in the three (3) months preceding the event.

14) Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the services, your breach of these Terms, or your violation of law or third-party rights.

15) Dispute Resolution; Governing Law

Informal resolution:

Contact us first to try to resolve any dispute.

Arbitration:

Any dispute not resolved informally will be finally resolved by binding arbitration on an individual basis in Los Angeles County, California, under the rules of JAMS or AAA, before a single arbitrator. You and we waive any right to a jury trial or to participate in a class action, to the extent permitted by law.

Governing law & venue:

California law (without regard to conflict of laws) governs these Terms. For matters not subject to arbitration, exclusive venue is state or federal courts in Los Angeles County, CA.

Consumer rights notice:

Some jurisdictions may not allow mandatory arbitration/class waivers; if unenforceable, the dispute will be heard in the courts above.

16) Changes to Services and Terms

We may modify services and update these Terms from time to time. The Effective Date above indicates the latest version. Material changes will be posted on the site and/or sent via email where required. Continued use after changes means you accept the updated Terms.
